Patinack Farm has filed documents in the NSW Supreme Court seeking more than $6 million from trainer Anthony Cummings and his companies.
The Sydney Morning Herald reported Patinack Farm lodged a claim of $6.4 million for the “loss in value of horses Cummings bought on its behalf and trained until they were broken down or lame, preventing them earning winnings”.
Patinack Farm has alleged the Randwick-based trainer was in breach of his duty of care when training the operation's horses.
Patinack has also alleged Cummings wrongly took commissions and fees from the purchases of yearlings bought on their behalf during the 2008 sale series.
Cummings has denied the allegations and the matter is due before the court for directions on March 9.
The court action is a counter-claim after Cummings sought $173,000 from the racing and breeding giant for unpaid training fees and costs.
Patinack principal Nathan Tinkler refused to pay Cummings , claiming the trainer had not performed all the work he was charging for.
